Subscription & Cancellation Terms

1. Managed Monthly Service Model

The Service is provided as a managed monthly subscription. It is not a one-time purchase of a custom website or software. Your continued access to the hosted website, AI intake chat, online booking calendar, Smartzilla intake dashboard, and related technology requires an active, paid subscription.

2. Subscription Fees and Billing

• Monthly Fee: The standard subscription fee is $297 per month (the “Subscription Fee”).
• No Setup Fee: Qualifying solo attorneys and small law firms are currently eligible for a $0 setup fee for the standard five-page system.
• Recurring Billing: Your Subscription Fee will be automatically charged each month to the payment method provided at the time of enrollment. The first payment is processed on the day of enrollment.
• Billing Cycle: Billing occurs on a monthly recurring basis starting from your enrollment date.

3. Term and Cancellation

• Month-to-Month: The Service is provided on a month-to-month basis. There is no long-term contract requirement beyond the current paid month.
• Cancellation Notice: You may cancel your subscription at any time by providing 30 days’ written notice to Smartzilla via email at support@smartzilla.ai.
• Final Payment: Because of the 30-day notice requirement, one final monthly payment may be processed after your cancellation request is received, depending on your billing cycle.
• No Refunds: Subscription Fees are non-refundable. We do not provide pro-rated refunds or credits for any partial subscription periods or unused services.

4. Service Deactivation and Data

• Deactivation: Upon the effective date of cancellation (at the end of the final paid service period), your Smartzilla-hosted website, AI intake chat, online calendar, and access to the Smartzilla intake dashboard will be deactivated and will no longer be accessible to you or the public.
• Firm Ownership: Your law firm retains ownership of its domain name and any original brand materials (logos, photographs) or written content provided by the firm to Smartzilla.
• Data Export: Upon written request within 30 days of cancellation, Smartzilla will provide an export of available lead and inquiry data captured through the system.
• No Automatic Transfer: Because the website is built using Smartzilla’s proprietary framework, hosting environment, and integrated technology, the website cannot be automatically transferred or migrated to another hosting provider or platform upon cancellation.

5. Optional Website Purchase or Migration

If you wish to retain a version of the website after cancellation, Smartzilla may, at its sole discretion, offer a one-time buyout or migration assistance service. The terms and pricing for such options are not included in the standard $297 monthly subscription and must be negotiated and agreed upon separately in writing.

6. Service Scope and Exclusions

• Included: Up to five (5) core marketing pages, one website language, hosting, routine technical maintenance, and routine updates to existing content (as defined on the Service landing page).
• Excluded: The Subscription Fee does not include advertising spend, advertising management, ongoing SEO, AI-search visibility services, blog writing, reputation management, phone numbers, calling/texting services, or custom software development.
• Additional Pages: Additional practice area pages, location pages, or other expansion content may be purchased for an additional fee.

7. Modifications to Terms

Smartzilla reserves the right to modify these Subscription Terms at any time. We will notify active subscribers of any material changes via email or through the Smartzilla intake dashboard. Continued use of the Service after such modifications constitutes your acceptance of the revised terms.
